My horse died recently from ingesting needles from a japanese yew (highly toxic) we had an autopsy done. The barn people turned him out into the ring where a brush jump was set up and of course I am sure they did not it was toxic and of course he nibbled on it. He died within 5 minutes. What knid of legal action can I take? or should I just move on?
Help! My horse was poisoned!?
Glad you had an autopsy done, you have legal proof of what happened.
You should at least be compensated for the REPLACEMENT value of your horse, not to mention a little pain and suffering.
The barn should have insurance for things like this. If you have other horses there, I would find a different barn.
Sorry for your loss.
Reply:If you were paying board at this stable and , unknown to you, employees of said stable turned your horse loose into the ring, then management seems to be liable in creating the situation. Because of their NEGLIGENCE, even if it wasn't willful ( i.e. - lack of informing the employees of the potential for harm that, sadly, your horse painfully experienced), you suffered a loss.
Smells like a lawsuit to me.
Yeah, see a lawyer...!
You could expect them to pay for the horse, its loss of use and medical bills incurred, at least. Perhaps even punitive damages (to teach the stable not to take such matters so lightly)...
Reply:I would believe you could sue their buns off....but I'm no lawyer.
there is a law section of yahoo answers that would be better help.
do let us know what they say, and keep us posted on all that happens please.
and I'm so sorry for your loss.
Reply:First of all did you have a contract with these people ? If so maybe they have insurance that will pay your for your horse. You should never board your hose with irresponsible people what were you thinking ? Have you talked to the people and ask them to pay for your lose, are they willing to help at least pay for half if not all before you go getting into a legal thing , I'm sure they are responsible for your horse. Good luck
Reply:you must avenge your horse!!!
make his skull into a helmet and his ribs/spine into a shield and also carve his legs into swords and kill the bastards that done this to your horse!!!!
you will have vengence!!!
Reply:Talk to a lawyer!
Reply:If it was me, I'd be considering legal action. It is or should be common knowledge that yews are poisonous to horses and livestock. They shouldn't be close enough for an animal to nibble on.
Reply:Call your lawyer and explain him the situation
He will surely tell what must goes on
Reply:get a lawyer.
